1. Acceptance of Terms
By accessing or using MemoryLane's services, you agree to comply with and be bound by these Terms of Service. If you do not agree with these terms, please stop using our services immediately.
2. Description of Service
MemoryLane provides a platform for users to capture, store, and share personal memories through various media formats. We reserve the right to modify, suspend, or discontinue any aspect of the service. Where reasonably possible, we will notify you of significant changes in advance. We will not make changes that materially disadvantage you without giving you a reasonable opportunity to delete your data and stop using the service.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. If you suspect unauthorized access, you must notify MemoryLane immediately.
4. User Content
You retain ownership of any content you upload to MemoryLane. By using our services, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of operating and improving our services. We will not use, share, or distribute your content for any other purposes without your clear and explicit permission.
4.1 Shared Content License
When you send or share content (such as photos or 'memories') with other users, you grant those specific recipients a non-exclusive, perpetual license to access and keep that content. If you choose to delete your account, shared content may remain visible to recipients but will be disassociated from your personal profile.
5. Prohibited Conduct
You agree not to engage in any of the following activities:
- Using the service for illegal or unauthorized purposes
- Uploading content that infringes on intellectual property rights or privacy laws
- Impersonating any person or entity
- Interfering with or disrupting the service, servers, or networks
- Attempting to gain unauthorized access to the service or other accounts
6. Intellectual Property
All content, features, and functionalities of MemoryLane are exclusively owned by MemoryLane and protected under international intellectual property laws.
7. Termination
We reserve the right to suspend or terminate your account and access to our services if you materially violate these Terms of Service. In cases where immediate termination is not required (in particular by law, the protection of other users, or the security of the service), we will give you reasonable prior notice and an opportunity to remedy the violation. You may terminate your account at any time by deleting your account in the app.
8. Disclaimer of Warranties
MemoryLane is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free from harmful components.
9. Limitation of Liability
We are liable without limitation for damages caused intentionally or through gross negligence, for damages resulting from injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz).
We are liable for damages caused by slight negligence only if we breach a material contractual obligation (Kardinalpflicht), and in that case only for the foreseeable, contract-typical damage. This limitation also applies to our legal representatives and agents.
The above limitations do not apply to claims under mandatory consumer protection law.
10. Indemnification
You are responsible for your use of the Service and for the content you upload. To the extent permitted by law, you shall indemnify MemoryLane against damages and reasonable costs (including reasonable legal fees) that MemoryLane incurs as a result of your culpable breach of these Terms of Service or your culpable infringement of the rights of third parties. This indemnity does not apply where the damage is caused by MemoryLane's own fault.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect.
12. Privacy & Data Protection
MemoryLane complies with the General Data Protection Regulation (GDPR) and other applicable privacy laws. We collect and process personal data only as necessary to provide our services. You have the right to access, correct, or delete your personal data at any time. For more details, please refer to our Privacy Policy.
13. Age Requirement
MemoryLane is intended for users who are at least 13 years old (or 16 years old in some EU countries). By using our services, you confirm that you meet the minimum age requirement.
14. Content Moderation & Reporting
MemoryLane reserves the right to remove any content that violates our Terms of Service or applicable laws. Users can report unlawful or inappropriate content through our in-app reporting system or by contacting [email protected].
15. Governing Law & Dispute Resolution
These Terms of Service are governed by the laws of the Federal Republic of Germany and the European Union, without prejudice to mandatory provisions of the law of the country in which you have your habitual residence. Any disputes arising from these terms shall be resolved through mediation or in the appropriate court of jurisdiction. EU residents may also contact their national consumer protection authorities for dispute resolution.
16. Changes to Terms
We may update or modify these Terms of Service. You will be notified of any significant changes via email or in-app notification at least 30 days before they take effect. If you do not agree with the changes, you may terminate your account and stop using the service before they take effect. Changes that are necessary to comply with legal requirements or to close security gaps may take effect immediately; in that case you will be notified as soon as reasonably possible.

18. Third-Party Platforms & App Stores
You acknowledge that these Terms are between you and MemoryLane only, not with Apple, Google, or any other app store provider. MemoryLane is solely responsible for the Service and its content. Apple and Google have no obligation to furnish any maintenance or support services with respect to the Service.
To the extent that you access MemoryLane through the Apple App Store or Google Play, the terms of those stores (including the Apple Media Services Terms and Conditions) apply to your use of the respective platform. In the event of any conflict between these Terms and the applicable app store terms, these Terms prevail solely to the extent that they do not conflict with the mandatory terms of the app store. If you have a dispute with MemoryLane relating to the Service, MemoryLane is responsible for addressing any such claim, and neither Apple nor Google is responsible for any claims related to the Service.
